I’m thrilled to bring you some exciting news about Biden’s NEW PAROLE IN PLACE 2024 program! This new initiative is meant to offer a much-needed lifeline to many undocumented individuals, particularly the spouses and stepchildren of U.S. citizens, who have been living in the United States for at least 10 years (or since June 17, 2024 for stepchildren).

What’s the Buzz About Biden’s Parole in Place 2024?

On June 18, 2024, President Biden announced a series of major updates to our immigration policies. These changes aim to provide critical support and a path to stability for many undocumented individuals. This latest update focuses on helping the spouses and stepchildren of U.S. citizens who’ve been in the country for over a decade. Sounds promising, right? Let’s dive into the details! 

Who’s Eligible?

Here’s the rundown:

  • Spouses and stepchildren of U.S. citizens who’ve been living in the U.S. for a certain period of time might be eligible to apply for their green card without having to leave the country if granted parole-in-place.
  • To qualify as the spouse of a U.S. citizen you must, as of June 17, 2024:
    • Be in the United States after entering without permission (unfortunately this does include individuals who who previously entered on a valid visa and overstayed – however there is other options if that is you!);
    • Have lived in the United States continuously for at least ten years without leaving;
    • Be legally married to a U.S. citizen; and
    • Not have a criminal history or pose a threat to national security or public safety.
  • To qualify as the stepchild of a U.S. citizen you must, as of June 17, 2024:
    • Be in the United States after entering without permission;
    • Have been under the age of 21 and unmarried;
    • Have lived in the United States continuously since June 17, 2024 without leaving;
    • Have a qualifying stepchild relationship with a U.S. citizen (The noncitizen parent must have entered into a legally valid marriage with a U.S. citizen on or before June 17, 2024 and it was before the stepchild’s 18th birthday); and
    • Not have a criminal history or pose a threat to national security or public safety.
  • If you check all the boxes, the government MAY grant you parole-in-place.
  • If approved, parole would be granted for a one-time period of three years, and you might also be eligible to apply for employment authorization for up to three years too.  Once you are granted parole then you can start the process to get your permanent residence in the United States!

What Does Parole-In-Place Mean for You?

If you’re granted parole, you have a three-year window to apply for your green card. Eligibility is decided on a case-by-case basis, so it’s important to get personalized advice tailored to your situation from a qualified immigration attorney like me.

  • ONLY ONLINE FILING OF APPLICATIONS! Applicants can only apply ONLINE using the Form I-131F. Any paper filings will be rejected.
  • BE PATIENT! It’s essential to find the right help. Getting the wrong advice could really mess up your chances of staying in the U.S., getting lawful status, or ultimately becoming a U.S. citizen. YOU DON’T HAVE TO BE THE FIRST PERSON IN LINE TO GET APPROVED. It is better to find the write assistance and do it correctly then rush and file incorrectly.
