The U.S. District Court of California ordered that the USCIS final rule creating a wage-based selection process for H-1Bs be vacated. After review of the Plaintiff’s allegations against the final rule, the court agreed and concluded that they will set aside this rule because Chad Wolf, the Acting DHS Secretary, was not lawfully appointed at the time the rule was created.
