New 36-Month Green Card Extension for Form I-90 Applicants!

In Family Immigration, Szew Law Group Blog, US Permanent Residence (Green Card)

If you’re a lawful permanent resident or know someone who is, I’ve got exciting news regarding Green Card extensions. As of September 10, 2024, U.S. Citizenship and Immigration Services (USCIS) has extended the validity of Green Cards from 24 months to 36 months for those filing Form I-90, making the renewal process easier and giving applicants more breathing room while waiting for their new cards.

What Does This Mean for You?

If your Green Card is expiring, or has already expired, and you’ve properly filed for renewal on Form I-90, you’ll now receive a automatic 36-month extension of your card’s validity! Previously, USCIS only granted a 24-month extension, but the additional time aims to help accommodate longer processing times. This is especially good news for those who have been anxiously waiting for their new Green Cards. ⏳

How Does It Work?

Once you file Form I-90, USCIS will issue a receipt notice confirming that your application has been received. This receipt notice will now state that your Green Card is valid for 36 months past its expiration date, rather than just 24 months. Even better, this updated receipt notice can be presented along with your expired Green Card as proof of your lawful permanent resident status for travel and work authorization.

Already filed Form I-90?

No worries! USCIS began printing the updated automatic 36-month extension notices for individuals who have pending applications starting on September 10, 2024. So, if you’re currently waiting for your Green Card to be renewed, keep an eye out for your updated notice in the mail!

Employment Authorization

Wondering how this affects your work status? These receipt notices serve as proof of both your continued lawful status and employment authorization. This means you can continue to work and live in the U.S. while waiting for your new Green Card, without interruption to your daily life.

But What If I Lost My Green Card?

Don’t panic! If you no longer have your Green Card and need proof of your status while your replacement is being processed, there’s a solution for you, too. Simply request an appointment at your local USCIS Field Office by contacting the USCIS Contact Center. After you’ve filed Form I-90, USCIS may issue you an Alien Documentation, Identification and Telecommunications (ADIT) stamp, which will serve as temporary evidence of your lawful permanent resident status. Problem solved!

Why This Matters

This change is a big win for applicants who might otherwise face challenges due to long processing times. By extending the validity of Green Cards to 36 months, USCIS is offering more peace of mind and greater flexibility to Green Card holders while they await their renewed cards.
